Land market - lifting the moratorium on the sale of agricultural land
Despite the many existing land legislation, Ukraine still needs land reform. The main question facing the legislator and the Ukrainian society is whether or not there will be a land market. The land is our national wealth. The lifting of the moratorium on the sale of agricultural land should, according to the expectations of politicians especially keen on the reform, attract unprecedented investments into the economy and agriculture of Ukraine, and give the Ukrainians the opportunity to freely dispose of their own land.
Also, the IMF continues to insist on the early adoption of the law on the turnover of the land market and the lifting of the moratorium from the beginning of next year. In a recently signed memorandum between our government and the IMF, it is indicated that the Verkhovna Rada of Ukraine is scheduled to approve this law at the end of May 2017, then the moratorium from the end of 2017 will expire.
Articles 90 and 130 of the LC of Ukraine regulate the rights of land own Plots 50by50ft for Sale in Mpererwe ers and its sale, however, in accordance with clause 15 of Section X of the Transitional Provisions of the Land Code, the purchase and sale or other means of alienation of agricultural land plots is introduced subject to the entry into force of the law on land turnover, but not earlier January 1, 2018. This is the moratorium on the sale of agricultural land, which has set everyone's teeth on edge, which has not been lifted for many years.
But how ready are the people of Ukraine to lift the moratorium? Opponents of its cancellation fear that the situation of the 90s will repeat itself, when industrial enterprises and facilities were bought for a pittance. And the sale of agricultural land to foreigners will lead to the loss of the people of their main national wealth.
On the way to lifting the moratorium, a number of fundamental issues must be resolved.
1. The first of them are the subjects of the purchase of Ukrainian land. In the first, 5-10 years, these subjects definitely should not be foreigners.
2. The second question should be the priority of the purchase, i.e. residents of either the area or the area have the right to the first purchase.
3. The third should be the issue of land valuation, which should not be lower than that provided for by the terms of the Law of Ukraine "On Land Valuation". The question of the price of Ukrainian lands, which is almost the lowest in Europe, is the most acute in the light of the land reform.
Therefore, the lifting of the moratorium should begin with the sale of state-owned agricultural land, which will allow the price to form, stay at a certain level and prevent it from falling. At the same time, it is necessary to solve the issue of the method of sale at the same time. A transparent and convenient mechanism for the sale and purchase of land - auctions. When the land market is formed, it will be possible to begin lifting the moratorium on the sale of private land.
The land reform, which may well take place in 2017, will bring to the participants of the land market both many opportunities and many problems, one of which is the corruption component of any large-scale state project. The complexity of state regulation of land legal relations will require changes to numerous regulations.
The imperfection of the judicial system, which also has not yet completed its long path of reform, will not allow a sharp and quick reaction to land disputes, which, after the lifting of the moratorium, will arise everywhere and quickly.
Therefore, land reform and the removal of restrictions should be started in stages and in a specific area, as a pilot project. Otherwise, the repetition of the privatization mistakes of the 90s may have irreversible consequences for Ukraine.
In summer 2018, the rock turned out to be hot for agrarian not deprived of the vlast fields, but in the fields of legislative activity.
